These Terms and Conditions govern the use of the website and online store operated by SUB BUSINESS, LDA, with registered office at Rua da Veiga, Nº5, 4830-512 Póvoa de Lanhoso, Portugal, VAT No. 517494574, hereinafter referred to as “SUB-GIFTS.”

By placing an order through our online store, the customer declares that they have read, understood, and accepted these Terms and Conditions, as well as the Privacy Policy.

1. Purpose

SUB-GIFTS markets personalized textile products, specializing in made-to-order embroidery. All products are personalized according to the customer’s specifications and are therefore subject to specific rules regarding production, delivery, and returns.

2. Orders and Production Process

2.1. Orders are considered valid only after full payment confirmation.
2.2. Following payment, the customer will receive a digital preview for design approval.
2.3. Production begins only after the customer’s explicit approval.
2.4. The customer is entitled to unlimited revisions before final approval.

3. Customized Products and Waiver of the Right of Withdrawal

3.1. In accordance with Article 17 of Directive 2011/83/EU and Portuguese Decree-Law No. 24/2014 of February 14, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
3.2. By ordering a SUB-GIFTS product, the customer acknowledges and accepts this legal exemption.

4. Prices and Payment

4.1. All prices are listed in Euros (€) and include VAT at the applicable legal rate.
4.2. Available payment methods include: Credit/Debit Card and PayPal.
4.3. SUB-GIFTS reserves the right to change prices, conditions, or promotional campaigns at any time.

5. Shipping and Delivery Times

5.1. Production time is 5 to 7 business days after design approval.
5.2. Delivery times vary depending on the destination country and are displayed at checkout.
5.3. All shipments include tracking information.
5.4. SUB-GIFTS is not responsible for delays caused by carriers or customs authorities.

6. Warranties and Claims

6.1. If a product presents a manufacturing defect or does not match the approved design, the customer must contact us within 14 days of delivery.
6.2. SUB-GIFTS will review the case and, where applicable, will either reproduce the item or refund the amount paid.
6.3. Products damaged due to misuse or improper washing are not covered under warranty.

7. Intellectual Property and Customer Responsibility

7.1. The customer declares they hold the legal rights to the files, logos, or texts submitted.
7.2. SUB-GIFTS accepts no liability for third-party rights infringements resulting from customer-submitted content.
7.3. We reserve the right to refuse any design deemed offensive, illegal, or inappropriate.

8. Use of Product Images for Portfolio and Promotion

8.1. Unless otherwise stated at the time of purchase, SUB-GIFTS may use images of final products for promotional purposes (e.g., website, social media, portfolio).
8.2. The customer may revoke this authorization at any time by written request.

9. Data Protection

9.1. All personal data is processed in accordance with the General Data Protection Regulation (GDPR).

10. Disputes and Applicable Law

10.1. In the event of a dispute, the customer may resort to the EU Online Dispute Resolution Platform: https://ec.europa.eu/consumers/odr
10.2. These Terms and Conditions are governed by Portuguese law, and the competent courts are those of Braga, unless otherwise legally stipulated.
